Terms and Conditions for Participation

"Yamaha Raffle" – The boot Düsseldorf Raffle

1.1 The raffle "Yamaha Raffle" is being conducted by Messe Düsseldorf GmbH, Messeplatz, Stockumer Kirchstraße 61, 40474 Düsseldorf, Germany (referred to below as the "organizer").

1.2 The raffle is being held in the period from August 14^th to 29^th, 2019 (11.59 p.m.).

1.3 Participation is free of charge. Participants must only bear the costs involved in participating via the internet (i.e. the costs for using an internet connection). Participation and the chance to win are independent of the purchase of goods or use of services.

1.4 Participation is to be undertaken using the participation form on the www.boot.club website. By taking part in the raffle, the participant accepts these terms and conditions of participation.

2. Participation/Process

2.1 Participate by sending an email to the stated email-address boot.club@messe-duesseldorf.de which explains why the participant is the right person for the raffled trip and what charaterizes him / her and his companions as a sportfishing team. Participants also need to register as a boot.club member beforehand on the website www.boot.club.

2.2 The raffle is held for boot.club members only.

Any individual over 18 years of age who is a boot.club member and submits an email according to § 2.1 is entitled to participate. Employees of Messe Düsseldorf GmbH and of Yamaha Motor Deutschland GmbH, Hansemannstr. 12, 41468 Neuss may not participate in this contest.

2.3 To take part in this prize draw, the participant must send an email including the required information to boot.club@messe-duesseldorf.de.

2.4 A participant may submit as many entries as they wish. However, a participant may only win a total of one prize and may only be drawn once.

2.5 Participation via a prize draw service, an automated mass participation process by a third party, via agents or via other commercial providers is not permitted.

2.6 Participation may only occur through one account. If it is suspected that a participant is partaking in the prize draw using several different accounts, the competition organiser reserves the right to proceed as detailed in Clause 2.7. 

2.7 If these terms and conditions for participation are violated, the competition organiser reserves the right to exclude the participant from the prize competition. If necessary, in these cases, prizes may be retroactively withdrawn and reclaimed. 

3. Determination of the winners 

3.1 The winner will be determined at random on August 30th, 2019 from amongst all participants who applied by an email in accordance with these terms and conditions.

3.2 The winners will be contacted by e-mail. The subsequent proceedure to make the prize available to the winning participant will be arranged individually by email or phone. This includes the time and place for the hand-over and return of the boat as well as all further questions raised by the winner.

4. Prizes 

4.1  The winner will receive on loan a so-called Buster S aluminium boat for the weekend either September 07th - 08th or September 14th - 15th, 2019. The boat will be provided by Yamaha Motor Deutschland GmbH Hansemannstr 12 41468 Neuss in accordance with their own respective terms of usage. The boat will be provided including a 25 hp engine (boating licence required). The boat will be provided on a trailer that does not require any extra driving licence. Hand over of the boat through an employee of Yamaha Motor Deutschalnd GmbH or a contracted agency will take place at a time and date agreed individually with the winner. The boat is allowed to carry four persons maximum and may be used on any waters in Germany, inland or coastal, on which its usage is legally allowed.

4.2 The organiser reserves the right to distribute more prizes. 

4.3 The value of the prize may not be paid in cash, nor may any potential substitute for the prize be awarded. Also, the right to the prize is non-transferable.
 

5. Data protection / consent for use of personal data

5.1 A requirement for participation in the prize competition is that you register for it in accordance with Clause 2.3. 

5.2 Your personal data will be processed by Messe Düsseldorf GmbH insofar as required to organize and conduct the raffle.

5.3 Your personal data will not be passed on to any third parties, the personal data of the winner will only be passed on to Yamaha Motor Deutschland GmbH Hansemannstr 12 41468 Neuss insofar as this is required to make the prize available to the winner. Beyond this, personal data will not be processed or handed on to any third parties for any other purposes unless Messe Düsseldorf GmbH cooperate with a customer data processing service provider, we are required to provide data by law or cooperate with a service provider under obligation to confidentiality by profession in order to enforce our rightful claims.

5.4 By participating in the raffle, participants declare that they consent to their names being published on the website www.boot.club or in the boot.club newsletter if they are among the winners (according to §§ 4.1 or 4.2). In addition, participants agree that fotos and videos which are being taken of them and their companions by an employee of Messe Düsseldorf or a contracted agency while claiming the prize of the raffle may be published. Alternatively, the participant may produce his or her own fotos and videos of the activities connected with the prize of the raffle and make these available to Messe Duesseldorf for publication.

5.5 Further information - particularly on your rights - are available from the privacy terms and regulations of Messe Düsseldorf GmbH. These are accessible at www.messe-duesseldorf.com/privacy_policy. You can object to the usage of your data at any time on this website, by email to privacy@messe-duesseldorf.de or by written letter to Messe Düsseldorf GmbH, VG-R, PF 101006, 40001 Düsseldorf.

6. Limitation of liability

6.1 Insofar as claims are asserted by a winner in connection with the prizes received, these shall, to the extent as legally permissible, be directed directly against the manufacturer/dealer, supplier, tour operator or other service provider. Should claims in this respect arise at the organiser, these will be assigned to the respective winners.

6.2 The organizer is not liable for the execution of the claim of the prize, in particular not of the prize according to clause 4.1.

6.3 In particular, the organiser shall not be liable for any damage which may occur as a result of errors, delays or interruptions in the transmission, disruption or deletion of data, viruses or in any other way during participation in the campaign, unless such damage is caused intentionally or through gross negligence on the part of the organiser. Liability for culpable injury to life, limb or health remains unaffected.

6.4 The prize can only be made available to the winner on condition of signing a formal disclaimer of liability by the winner and his companions.

6.6 However, it is the obligation of the winner that all laws, regulations and licence requirements applicable in the area where the boat is used are met and observed. The organizers of the raffle are not liable for any damages resulting from any breaches of such regulations.

 
7. Other Items 

7.1 The law of the Federal Republic of Germany applies.

7.2 The competition organiser may alter, suspend or end the prize competition at any time, inasmuch as this is necessary due to circumstances that the competition organiser cannot influence or if the activity cannot otherwise be executed in line with requirements.
